#1: You Question the Lawyer’s Competence The primary reason you chose to work with a lawyer during this process is for their expertise, for their experience and ability to know exactly how to proceed. Should they miss a deadline, fail to file a key piece of paperwork, or overlook a critical opportunity to represent your interests, it could mean the difference between fair compensation for your injuries, and absolutely nothing. Ask to see your file and discuss your concerns, but if the attorney does not inspire confidence or appear to be at a loss, it is definitely time for a change. #2: The Lawyer Does Not Communicate With You Attorneys who fail to return client phone calls is a top complaint. You should be able to easily get in touch with your lawyer and have them contact you with regular updates. If they cannot take time to communicate with you, then maybe they are understaffed, overbooked, or incompetent, but in any case you need to find another lawyer. #3: You Do Not Trust the Lawyer’s Ethics and/or Judgment The attorney client relationship must be centered on trust, and you must be confident in their ability to see the case through. Once you start questioning their decision making for either ethical or practical reasons, you should seriously consider no longer working with them. #4: You and the Lawyer Have a Poor Relationship While you do not need to be close friends with your lawyer, it is critical that you be able to have a successful working relationship with them. You can not like your attorney much as a person but still find them to be capable, hardworking, and trustworthy. If, however, you and your attorney do not work well together, or you find yourself needing someone who you can connect with a bit more, look for a different lawyer. If any of these apply to your current situation, then rest assured that you should cease working with your attorney and immediately find another. Many law firms are willing to pick up a case that has already begun, and it is not worth the risk to continue working with a lawyer who does not have your best in mind or who is not effectively representing you.
