Where a party is seeking modification of legal decision making and/or parenting time the Court is required to evaluate the credibility of the parties and witnesses and cannot delegate that responsibility. The Court must have the opportunity to evaluate the credibility of witnesses including parents, step-parents and other witnesses with firsthand knowledge. The decision of witnesses to testify depends upon the credibility of that particular witness as the Judge is required to evaluate the credibility of each witness.
