The initial referral requires the non-testing party to appear in court for an orientation and must be available to participate by phone during further Family Drug Court hearings. FDC is designed to insure that parents develop the ability and skills needed to successfully and appropriately function as a parent substance free. Referral of the testing and non-testing party is required in order to facilitate effective co-parenting of the children.
The FDC is divided into two separate tracks, an intensive program of significant duration and a shorter program that focuses on education and testing. Both programs involve drug testing, reduced fees treatment/counseling, and frequent court appearances but the more intensive program involves more treatment services.
The track one consists of four phases, each lasting approximately three months. The services and time limits decrease as parents make progress through each phase. Track two is shorter in duration dependent upon treatment and testing progress. The Family Drug Court Judge reports each parents progress directly to the Judge presiding over the Family Court matter.
